1. Scope and acceptance
These Terms of Use govern access to Makr.ai and the related software, websites, tools, data, and documentation made available by N/A Records, Inc. and its affiliates (the Services). By accessing or using the Services, you agree to these Terms and the Privacy Policy.
If you use the Services for a company or another organization, you represent that you have authority to accept these Terms for that organization. If you do not agree to these Terms, do not use the Services.
2. Eligibility and accounts
You must be at least 13 to use the Services. If you are under 18, you must have permission from a parent or legal guardian. You must provide accurate account information, protect your credentials, and promptly tell us if you believe your account has been accessed without permission.
You are responsible for activity performed through your account. You may not sell, share, or transfer account access in a way that defeats plan limits or security controls.
3. The Service and AI output
Makr.ai can research, draft, generate, store, edit, and share creative work across several formats. Some features depend on third-party AI, research, media, infrastructure, storage, identity, and payment services.
AI output can be incomplete, inaccurate, similar to output created for others, or unsuitable for a particular purpose. You are responsible for reviewing output, checking consequential claims, obtaining required permissions, and deciding whether and how to publish or use it. We do not guarantee that output is unique, accurate, non-infringing, or fit for a particular use.
Private prompts, uploads, conversations, projects, and artifacts are not used by Makr.ai to train generative models. This privacy floor is the same for free and paid users. Additional detail appears in the Privacy Policy.
4. Your content and output
You retain your rights in prompts, uploads, files, instructions, and other material you submit to the Services (User Content). You represent that you have the rights and permissions needed to submit and use that content.
You grant N/A Records, Inc. a limited, worldwide, non-exclusive license to host, copy, process, transmit, display, and modify User Content only as reasonably necessary to provide, secure, support, and maintain the Services you request. This operational license does not authorize generative-model training on private content. It ends when the content is deleted from active systems, subject to reasonable backup, security, fraud-prevention, and legal-retention periods.
As between you and N/A Records, Inc., and to the extent permitted by law, you own the output you generate through the Services. We assign to you any rights we may have in that output. This does not transfer rights in third-party materials, licensed assets, models, software, trademarks, or other people’s content that may appear in or be used with an output.
5. Acceptable use
You may not use the Services to break the law; violate intellectual-property, privacy, publicity, or other rights; exploit or endanger minors; create unlawful sexual or violent material; impersonate or deceive people in a harmful way; distribute malware; facilitate fraud; bypass security or usage controls; scrape or overload the Services; or submit content you are not authorized to use.
We may investigate suspected abuse and restrict content, features, or accounts when reasonably necessary to protect users, third parties, or the Services, or to comply with law. Where practical, we will explain the action and provide a way to contact us about mistakes.
6. Fees and credits
Some features require Makr credits or another payment. The applicable price is shown in the product or purchase flow before you buy credits or start a paid generation. One Makr credit currently represents $0.01 of product value. Credits are not money, have no cash value, are non-transferable, and do not expire while the credit program remains available.
Credit-pack purchases are pay-as-you-go and do not create a recurring subscription. Except where required by law, completed credit purchases are final. Contact us promptly about duplicate charges, unauthorized purchases, or a verified service failure. A generation failure that the product identifies as uncharged will not consume credits.
If we later offer a subscription, its price, renewal period, included credits, cancellation timing, and any material restrictions will be disclosed at checkout before you subscribe. We will provide advance notice of material price changes to an active recurring plan when required by law.
Free and paid plans may differ in usage limits, available models, processing priority, storage allowances, inactive-content retention, export features, collaboration, and support. Those differences do not reduce the privacy protection for private content or make private content eligible for model training.
7. Third-party services and assets
The Services may connect to third-party products or send content to a provider when you request a feature that depends on that provider. Third-party services and licensed assets may be governed by their own terms, licenses, and privacy practices.
We do not grant rights in third-party content beyond the rights supplied by its owner or license. You are responsible for following any attribution, channel, territory, or use restrictions shown with an asset or connected service.
8. Changes, suspension, and termination
The Services will change over time. We may add, modify, or discontinue features and may suspend or terminate access for material violations, legal or security reasons, nonpayment, or discontinuation of a service.
You may stop using the Services at any time. Before closing an account, export any work you need to keep. You may contact us to request account deletion. Some information may remain for a limited period in backups or where needed for security, fraud prevention, billing records, dispute resolution, or legal obligations.
9. Copyright concerns
If you believe material available through the Services infringes your copyright, contact hello@makr.ai with identification of the protected work, the allegedly infringing material and its location, your contact information, a good-faith statement that the use is not authorized, and a statement that your notice is accurate and that you are authorized to act for the rights holder. We may request additional information before acting.
10. Disclaimers
To the extent permitted by law, the Services are provided “as is” and “as available.” N/A Records, Inc. disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise uninterrupted availability or that every error will be corrected.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded. Some jurisdictions provide consumer rights that these Terms do not override.
11. Responsibility and liability
You are responsible for your User Content, your instructions, and how you review, publish, distribute, or use output. You will not hold N/A Records, Inc. responsible for claims caused by content you were not authorized to submit or by an unlawful use of the Services.
To the extent permitted by law, N/A Records, Inc. is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities.
12. Governing law and disputes
California law governs these Terms without regard to conflict-of-law rules, except where the law where you live requires otherwise. Before bringing a formal claim, please contact hello@makr.ai so we can try to resolve the issue informally. These Terms do not impose mandatory arbitration or a class-action waiver.
13. Changes and contact
These Terms are effective August 12, 2026. We may update them as the Services or law changes. If a change materially reduces your rights, we will provide reasonable notice through the Services, by email, or by another appropriate method. Questions can be sent to hello@makr.ai.
